Potential Implications for Federal Law Raised by the October 2010 Draft of the Anti-Counterfeiting Trade Agreement

This memorandum is in response to your request that the American Law Division (ALD) of the CRS analyze whether the commitments put forward in the October 2, 2010 draft version of the Anti-Counterfeiting Trade Agreement (ACTA) diverge from existing federal law or would impede current and future legislative efforts in the area of reform to damages for patents or access to orphaned copyrighted works.
