The Group of Latin American and Caribbean Countries (GRULAC), delivered a statement supporting initiatives and proposals aimed at expanding and facilitating education, research, and the preservation of cultural heritage in developing countries. GRULAC also advocated for the implementation of WIPO’s Development Agenda (DA) recommendations and the fulfillment of the Sustainable Development Goals (SDGs) established by the United Nations. The statement was delivered by the Bolivarian Republic of Venezuela delegation speaking on behalf of GRULAC during the World Intellectual Property Organization’s (WIPO) General Assembly 2023.

“Madam Chair,

GRULAC advocates for the promotion of a balanced Intellectual Property system, which effectively protects the rights of the holders, but which ensures adequate access to knowledge, innovation, technology and culture for the full development of society. In this sense, GRULAC promotes the development dimension of the Intellectual Property system, that is, an Intellectual Property system that promotes production and innovation in developing countries and that allows generating solutions to global problems of a social nature, environmental and economic problems that afflict both the developing and the developed world.

In consideration of the above, GRULAC strongly supports initiatives and proposals that broaden and/or facilitate education, research, and the preservation of cultural heritage in developing countries, as well as the implementation of the recommendations of the Development Agenda. of the Organization and the fulfillment of the Sustainable Development Goals of the United Nations Organization, all of which operate as our imprint.

Likewise, GRULAC advocates for the promotion of an Intellectual Property system that favors equity, diversity and inclusivity to offer opportunities to all members of society, particularly the most vulnerable. For this reason, in the last session of the Program and Budget Committee, GRULAC, with the support of the African Group, presented a proposal that seeks to guarantee the participation of indigenous peoples and local communities in the Diplomatic Conference for the Celebration of a International Legal Instrument related to Intellectual Property, Genetic Resources and Traditional Knowledge associated with Genetic Resources, which will take place in 2024. GRULAC maintains open channels of communication with the delegations, to find a compromise formula that leads to approval of this important decision.

Another topic of great importance for GRULAC is the Marrakech Treaty, which this year celebrates 10 years of having been adopted, on June 27, 2013. GRULAC promoted and promoted this Treaty, convinced of the positive impact that the establishment of limitations and exceptions obligations to copyright has on people who are blind, visually impaired or have other difficulties in accessing printed text.

GRULAC would like to conclude by reiterating our willingness to work hand in hand with you and the membership to ensure the success of this 64th series of Assemblies of the World Intellectual Property Organization (WIPO).

“Señora Presidenta,

El GRULAC aboga por la promoción de un sistema de Propiedad Intelectual equilibrado, que proteja efectivamente los derechos de los titulares, pero que asimismo asegure un adecuado acceso al conocimiento, la innovación, la tecnología y la cultura para el íntegro desarrollo de la sociedad. En ese sentido, el GRULAC promueve la dimensión de desarrollo del sistema de Propiedad Intelectual, esto es, un sistema de Propiedad Intelectual que impulse la producción y la innovación en los países en desarrollo y que permita generar soluciones a los problemas globales de carácter social, medioambiental y económico que aquejan tanto al mundo en desarrollo como al mundo desarrollado.

En consideración a lo anterior, el GRULAC apoya decididamente las iniciativas y propuestas que amplían y/o facilitan la educación, la investigación y la preservación del patrimonio cultural en los países en desarrollo, así como la implementación de las recomendaciones de la Agenda para el Desarrollo de la Organización y el cumplimiento de los Objetivos de Desarrollo Sostenible de la Organización de las Naciones Unidas, todos los que operan como nuestra impronta.

Asimismo, el GRULAC aboga por la promoción de un sistema de Propiedad Intelectual que privilegie la equidad, la diversidad y la inclusividad para ofrecer oportunidades a todos los miembros de la sociedad, particularmente a los más vulnerables. Por ello es que, en la pasada sesión del Comité del Programa y Presupuesto, el GRULAC, con el apoyo del Grupo Africano, presentó una propuesta que busca garantizar la participación de los pueblos indígenas y comunidades locales en la Conferencia Diplomática para la Celebración de un Instrumento Jurídico Internacional relativo a la Propiedad Intelectual, los Recursos Genéticos y los Conocimientos Tradicionales asociados a los Recursos Genéticos, que se llevará a cabo en 2024. El GRULAC mantiene canales abiertos de comunicación con las delegaciones, para encontrar una fórmula de compromiso que lleve a la aprobación de esta importante decisión.

Otro tema de gran importancia para el GRULAC es el Tratado de Marrakech que este año cumple 10 años de haber sido adoptado, el 27 de junio de 2013. El GRULAC promovió e impulsó este Tratado, convencido del impacto positivo que el establecimiento de limitaciones y excepciones obligatorias al derecho de autor tiene en las personas ciegas, con discapacidad visual o con otras dificultades para acceder al texto impreso.

El GRULAC quisiera concluir reiterando nuestra voluntad de trabajar de la mano con usted y la membresía para asegurar el éxito de esta 64° serie de Asambleas de la Organización Mundial de la Propiedad Intelectual (OMPI).
