New Nigerian Copyright Act Creates Open Fair Dealing Exception
[Jonathan Band] Nigerian President Muhammadu Buhari has assented to a new copyright act that updates the country’s exceptions and limitations for the digital environment. Most significantly, the act replaces a closed fair dealing provision based on the English copyright law with an open provision modeled on the U.S. Copyright Act’s fair use right. The adoption of an open fair dealing provision by Africa’s largest producer of copyrighted material should put to rest arguments elsewhere on the continent that open exceptions are inimical to copyright industries.
Developmental and Cross Border Uses of Copyright Limitations and Exceptions
[Sean Flynn] Where allowed by copyright law, digital uses for education, research and cultural heritage are contributing to social and economic development. This document describes some recent developmental uses of copyright limitations and exceptions that are relevant to the issues being discussed at the 43rd meeting of the WIPO Standing Committee on Copyright and Related Rights. The examples were collected by members of the Access to Knowledge Coalition.
Right to Research and Copyright Law in Kenya: Text and Data Mining
[Chebet Koros, Joshua Kitili, Cynthia Nzuki and Natasha Karanja] …The Strathmore University Centre for Intellectual Property and Information Technology Law carried out a study to determine the relationship between Kenya’s technology and copyright legal framework that affect the use of TDM research. It had four specific targets: to determine if Kenya’s technology policy promotes technology, learning, and research; to understand the prospects and plans for enabling a legal environment for research and development of technology; to assess the role of copyright law in enabling TDM research, and finally to provide recommendations for national, regional, and international copyright policies that enable TDM research. This policy brief is a summary of that study with specific policy recommendations resulting from the study.
A Right to Research in Africa
[Sean Flynn] The Right to Research in International Copyright Project hosted a week of conferences in South Africa, January 23-27, 2023. The week of public and private meetings in Pretoria and Cape Town featured discussions of how African researchers are using modern digital technologies to address a range of pressing research questions that require use of research exceptions in copyright law. Academics, practicing lawyers and government officials from several African countries provided the legal and policy context for the researchers’ work, illuminating both the flexibility in many African laws that permit research uses, as well as where changes in domestic and international law could serve the public interest.
TDM and Brazilian Copyright: Recent Developments
[Allan Rocha de Souza and Luca Schirru] Statutory limitations and exceptions (L&E) for copyright in Brazil are notoriously precarious. However, under the Constitutional framework, the courts have come to regard their interpretation as extensive and not limited to the situations set forth in the copyright law. As it stands now, they must be considered as a flexible set… Despite the flexible character of L&Es in Brazil, none of them directly addresses uses for the purpose of research or text and data mining (TDM). Nonetheless, policy discussions (both within the legislature and the executive) have started to address the issue, particularly in relation to innovation and the training of Artificial Intelligence (AI) systems.
Reconceptualizing Open Access to Theses and Dissertations
[Orit Fischman Afori and Dalit Ken-Dror Feldman] … The modern perception of TD has generated a call for their greater accessibility, as part of the Open Science movement. Nevertheless, in many countries around the world TD are not published in an open access format. While the normative basis for open access approach to publicly funded academic research is extensively discussed in the literature, there is a lack of legal and normative discussion concerning the special case of TD. The present study aims at filling this gap. We argue that the essence of TD as unique outputs of academic research merits a special stance compelling the publication of these studies in open access format, subject to certain exceptions.
A Week of Events on Copyright and Access to Knowledge in South Africa
[PIJIP] A coalition of academic and civil society organizations are co-organizing a week of debates on copyright and access to knowledge in South Africa, beginning on January 23rd. The organizers for these events are American University’s PIJIP, the University of Pretoria’s Future Africa, the University of Cape Town IP Unit, the Strathmore University Centre for Intellectual Property and Information Law, the South Centre, Electronic Information for Libraries, Masakhane and the Wikimedia Foundation.
The Italian Implementation of the New EU Text and Data Mining Exceptions
[Deborah De Angelis] The legislative decree implementing the CDSM Directive in Italy was adopted on November 8th, 2021, and published in the Gazzetta Ufficiale on November 27th. It came into force on December 12th, 2021, amending the Italian Copyright Law. This blog post analyses the implementation of the copyright exceptions for Text and Data Mining, which is defined in the Italian law as any automated technique designed to analyse large amounts of text, sound, images, data or metadata in digital format to generate information, including patterns, trends, and correlations (Art. 70 ter (2) LdA). As we will see in more detail below, the Italian lawmaker decided to introduce some novelties when implementing Art. 3, while following more closely the text of the Directive when implementing Art. 4.
Examples of Text and Data Mining Research Using Copyrighted Materials
[Sean Flynn and Lokesh Vyas] Last week, Science Magazine published a joint academic opinion by leading copyright scholars from around the world calling for copyright reform to enable text and data mining (TDM) research. The opinion calls for all countries to evaluate their laws, and for international institutions to guide them, so that text and data mining research can take place everywhere, including through cross-border collaborations between researchers in different countries. In this article, we survey some of the kinds of important TDM projects that need copyright permission to be enabled everywhere.
Reforming Copyright or Toward Another Science? A More Human Rights-Oriented Approach Under the REBSPA in Constructing a “Right to Research” for Scholarly Publishing
[Klaus Beiter] Abstract: This article identifies copyright impediments existing in the sphere of science, to then make (tentative) suggestions as to how these may be overcome. It focuses on scholarly publishing only, and here primarily on digital content, specifically asking whether expensive commercial scholarly publishers continue to “add value” to research in the digital era. The deficits of copyright law and potential solutions thereto are assessed in the light of the right of everyone “to enjoy the benefits of scientific progress and its applications” (REBSPA) as laid down in Article 15(1)(b) of the International Covenant on Economic, Social and Cultural Rights (ICESCR) of 1966. A substantial part of the discussion examines whether and, if so, in what ways, the REBSPA gives rise to a “right to research,” also in an extraterritorial sense that would require the right to be respected beyond borders, and what the normative implications of such a right would be for copyright and science.
